Mercenaries or why does the US spend 3 times more on war today than during the Cold War?

          This post, linked to several previous ones see here and here, will offer a new and broader perspective on the 4 and perhaps 5 wars which the US is actively fighting (Afghanistan, Iraq, Pakistan, Yemen and Somalia; I leave aside Palestine where it arms Israel and Iran where despite "covert" operations, Obama is so far avoiding the neocon push to bomb Natanz) and how to think about this morally speaking.  Here, I focus on 3 startling statistics, one of which I have given before.  First, the US now spends in official terms $630 billion dollars on war, 2 1/2  times more than it did than at the end of the Cold War (according to Reuters today, Obama's new war budget is $708 billion).  If one adds in extra money for Afghanistan and Iraq and an estimate at the shadowy intelligence budget, the figure would grow to perhaps $1 trillion a year, 4 times the amount the US spent on fighting the Soviet Union at the end of the Cold War.  

       The second figure is that for a majority mercenary army in Afghanistan: there, Obama is employing 70% contractors and 30% soldiers.  This is new. See here.   In Iraq, it was “only” 1 to 1.

      I have recently been puzzling over why the expense should now be so much more than during the Cold War.  After all, the USSR was a nuclear armed power, and the expenditure on weapons, as Chalmers Johnson argued in Blowback, broke it, as Johnson also imagined such expenditure might soon break the United States of America. Consider the economic collapse, the astonishing war budget and Obama’s State of the Union promise to freeze decent spending but not the Pentagon.  The Reuters article below reveals that the weapons expenditure figure is $112 billion, less than one-sixth of today's war budget.   Johnson also tells the story, worth taking in, of the 800 military bases, "the empire of bases" (chapter 6 of Sorrows of Empire) whereas other powers have almost none (France has 5 in former "French" Africa). 

      But Johnson is partly wrong as to the cause of the escalated expenditure.  The two sister-in-laws of my older son have both married military men.  One is a mechanic, the other a soldier.  He has re-upped because of a sizable bonus and because his wife can live decently on a military base to a raise a new baby.  What other job possibilities did these young men have (ones, for example. where their lives might not be at risk?).  Paul Krugman suggested a few years ago in the Times that the American economy consisted of making weapons and swapping houses.  We no longer swap houses. We might, as Obama again emphasized in the State of the Union, move toward green jobs, but as Krugman and others have rightly noted, Obama has squandered the political enthusiasm that would have projected this much more strongly through an adequate stimulus bill.  Obama initially could have spent enough money to both launch this project, vital to a flourishing U.S. economy, more effectively and drive unemployment down to an official 7 or 8 per cent. 

         The “volunteer” military costs more than the conscripted army, which the United States abandoned after Vietnam.  The government gave up the draft corruptly because citizens, particularly those who might be forced to go, protested so strongly against unjust wars.  The injustice of Vietnam and the lying pales beside the aggression – the sheer criminality and torture – in Iraq.  See Glenn Greenwald’s comparison of the US and British accountability here.* But buying an army – creating a mercenary army – makes it easier to commit war crimes with public distaste (no one likes the war) but without as much militant protest.  A qualification; including in the United States, the biggest movement against a War before it started took place against the criminal enterprise in Iraq.  The sentiments from that movement helped elected an anti-Iraq War candidate, Barack Obama (it was the defining difference with Hilary Clinton).  Those who talk about how the draft simply motivated protest and there isn’t so much now on campus, miss this fundamental and striking point.  Nonetheless, the large anti-war movement sadly lacked the militancy that the anti-Vietnam war movement eventually developed, perhaps because personal survival was not on the line.  Mass nonviolent protest could very likely have stopped the war (the UN turned it down; the American-British aggression nakedly lacked international legitimacy).

         But the elite has come up with a new wrinkle: the privatization or mercenarization of war.  Why pay ordinary soldiers when the government could get all kinds of mercenaries, paying them ten times as much?  These cadillac mercenaries could be immune from war crimes.   They were thus useful along with the CIA in executing torture (the shadowy Steve Stefanowicz of CACI who was not indicted at Abu Ghraib while Lynndie England and Charles Graner took the fall).  Or shooting civilians in Nissour Square (Blackwater/Xe ops are much more likely routinely to use lethal force against civilians than ordinary soldiers).  And Xe turns out to be the bodyguards of Hamid Karzai or American officials in their palatial “embassies” in Kabul and Baghdad.  Xe-ops are right there among the CIA being blown up in Afghanistan.  The US government, has been increasingly eaten by Blackwater and its Christian crusader chief executive, Eric Prince.  Not the government but private companies decide who will do what, and for what there will be penalties (Prince is being charged in court by two Blackwater employees for killing one of their fellows, but the case is likely   – Prince knows too much about American operations – beyond the reach of law).

       Mercenarization drives the multiple inflation of the military budget beyond Cold War levels.  Not weapons, but as Jefferson said of King George once upon a time, mercenaries. But not old style mercenaries, not an adjunct to a regular, even a mercenary army, but a massive modern military budget for cadillac mercenaries, the main force as in Afghanistan, mercenarization on steroids.  If you have seen the company soldiers in the movie Avatar, this fantasy has become an apt symbol for these American imperial wars.   And this horror is kept secret from the public even by Obama, a decent man and an anti-Iraq War Democrat.  If you want to see what America has become – even beyond a state where aggression and torture are the way of the elite and at minimum, even though Obama has (largely) halted torture, no one will be punished, take a look at this eating of the government – now made bipartisan - from within. Obama has done some things to improve American policy – he no longer refers to an irrational “War on Terror,” he tries to address other powers in a civilized way and promote negotiation (accompanied with belligerence).  And yet he extends mercenarization. 

       Except for mass civil disobedience, there seems little way to change this.  My friend Gary Hart this week gave a wonderful talk at the Josef Korbel School of International Studies about thinking in new ways about the security of ordinary Americans in the 21st century.  He had been the leader of the Hart-Rudman commission and fought, unsuccessfully, to get word of the likelihood of 9/11 into the Bush administration as late as September the 6th, 2001, in a meeting with Condi Rice. He is an admirable thinker about these issues.  He makes the point that most politicians and "experts" in the war complex say the same things over and over, are not interested in fresh ideas.   I asked him what we could do about this soaring war budget, this feeding of Blackwater/XE, as destestable as AIG and far less necessary except for the histrionics of fear.  He couldn’t think of anything either.  Practical suggestions from readers are more than welcome.

      As Clinton outdid the Bushes on corrupt trade arrangements – the World Trade Organization which listens only to commercial representatives and overturns national, that is, democratically voted, laws for human rights, environmental protection and the like- so Obama outdoes W., sadly, on the privatization of war (see Michelle Sforza, Whose Trade Organization?). Companies who will do basic public services for the money’s sake alone are now eating government – once again, a common good - from within.    The ratio of mercenaries to soldiers was about 1 to 1 in Bush’s Iraq.  So in Iraq there have been about 260,000 American forces; agents immune from prosecution for war crimes, embody a whole independent direction from seeming or public American policy (they obey Pentagon orders if to their Corporation is forthcoming).  In Afghanistan with Obama’s “surge,” there will be about 220,000 troops.   The need to keep what is really going on in both cases from the American people – the failure to announce publically the real figure the US government is paying for, to include contractors in the public accounting - is a startling sign of public corruption (in ancient Greek terms, corruption means tyrannical service to a particular interest rather than sustaining a common good – see here).  Both Bush and Obama are, in fact, ashamed of this (and should be): hence the silence.  

    The third figure is about unemployment among poor black teenagers.  It used to be around 40%.  But a depression has a way of asserting itself in the poorest working class communities.  According to the New York Times’s editorial December 22, 2009, 

    “According to the analysis, the joblessness rate for teenagers generally is the highest ever since the country began keeping statistics just after World War II. Things are especially bleak for low-income black students: only 4 in 100 found work this fall.”

4 poor black teenagers in 100 - 96% do not find work.  Of course, this is a sharp incentive, as  Daniel P. Moynihan and Robert McNamara used to say, for driving them to become soldiers in an Imperial army.  

       There is also a huge racial divide between the troops who aren’t well paid  and subject to stop-loss (also among Chicanos and rural whites) and highly paid mercenaries led by Eric Prince.  The mercenaries are immune for war crimes and stop-loss.  On a plane ride to visit my daughter in Seattle, I sat next to Valerie, a wonderful young black soldier and former philosophy student at the University of New Orleans,  Valerie who asked me about the post I was writing on Hilary Putnam’s account of how one should morally and politically assess war.  She had studied the idea of just war more intensely than those less concerned.  She spoke to me about how most soldiers hated Bush and think the US army murdered the American hero Pat Tillman (see here). 

      Ordinary soldiers are not under the influence of “big money,” but are demoralized by the treatment of Cadillac mercenaries.   Yet Obama is now trying to surround them with or deluge them in such mercenaries.  This is a divided and I suspect increasingly unstable “army,” sent far from home to occupy and dominate hostile, nonwhite peoples or to kill through the blind use of drones (we don’t know who we firing at and General Stanley McChrystal’s warnings notwithstanding, do not exercise much care). Once again, this is military service for sale, the transfiguring role of Cadillac mercenaries…

        I find all of this, particularly in the Obama era which seemed initially hopeful, frightening.  Though starting or escalating two new wars in Pakistan and Yemen, Obama’s words (having dropped the war on terror and the scary rhetoric about Iran and Palestine – I follow Obama here in referring to the occupied territories) still holds out some hope.  But these are three dimensions of a novelly decadent Imperial era whose trajectory for ordinary Americans and others (all of us) is startlingly downward.

      In addition, in Democratic Individuality and Must Global Politics Constrain Democracy, I  have referred to American regime as an oligarchy with parliamentary forms.  In the latter,  I also used a longer phrase drawn from Hans Monganthau’s addition of an academic-political complex to President Eisenhower’s military-industrial complex and added media to it (today one might also speak of think tank experts rather than academics most of whom opposed the Iraq war).  As a short hand for military-industrial-think tank "expert"-political-media complex, I call this the war complex.  But given these thoughts about the miliary budget, one might speak especially now of a mercenary war complex.  Like a slow powerful parasite, the private has eaten the governmental and only the colorful but corpselike outer sheath remains.  I am not sure any of us - certainly not me – have understood the full impact of what is happening. But perhaps it may help to give it a true name.

       On the latest American aggression in Yemen, Joe Lieberman, who is the voice of the war complex as of the medical anti-"insurance" companies (they drop the insured when they are sick), proclaimed “preemption in Yemen.”  As Patrick Cockburn who has actually been to Yemen  (Lieberman has done some flybys to Iraq with McCain), reports strikingly in the Guardian, the US, invading country after country, blowing up 50 women and children at a Yemeni wedding party for instance, makes ever new enemies for Americans.  This would not be offset even by the benefit of killing bin Laden (getting the leader of Al-Qaida would be a great political triumph in the United States for Obama, but the rest of the policy would exacerbate the specter which Bin Laden incarnates).  That Obama, an intelligent and decent man, continues this mindless and counterproductive activity of aggression – we shoot off drones because we can, if Yemeni women and children are killed, what does the big bad CIA care? – is a sign of the self-undermining power of the war complex.  This is hubris, driven by money.   Obama does it because he always wanted to be President (he could have been a great president unlike most who have come to the office, but under constant attack from Republican authoritarians and pressure from the war complex and other corporations, he has mainly settled for being President…).    

        As Cockburn suggests,

       It is extraordinary to see the US begin to make the same mistakes in Yemen as it previously made in Afghanistan and Iraq. What it is doing is much to al-Qa'ida's advantage. The real strength of al-Qa'ida is not that it can ‘train’ a fanatical Nigerian student to sew explosives into his underpants, but that it can provoke an exaggerated US response to every botched attack. Al-Qa'ida leaders openly admitted at the time of 9/11 that the aim of such operations is to provoke the US into direct military intervention in Muslim countries."

          “In Yemen the US is walking into the al-Qa'ida trap. Once there it will face the same dilemma it faces in Iraq and Afghanistan. It became impossible to exit these conflicts because the loss of face would be too great. Just as Washington saved banks and insurance giants from bankruptcy in 2008 because they were ‘too big to fail,’ so these wars become too important to lose because to do so would damage the US claim to be the sole superpower.”

         “In Iraq the US is getting out more easily than seemed likely at one stage because Washington has persuaded Americans that they won a non-existent success. The ultimate US exit from Afghanistan may eventually be along very similar lines. But the danger of claiming spurious victories is that such distortions of history make it impossible for the US to learn from past mistakes and instead it repeats them by fresh interventions in countries like Yemen.”

       Cockburn is mistaken here.  The sands are already running through the hour glass on our five wars and economic collapse.  Each new atrocity against civilians by drones or Blackwater/Xe breeds new enemies and makes the policy more and more counterproductive over time. Cockburn also shows how our or our subordinates’s policies of punishing the decency of ordinary Arabs – most of them won’t be bought to serve our corrupt purposes – have led to poverty and anger among Yemenis:

       “One of the reasons the country is so miserably poor, with almost half its 22 million people trying to live on $2 a day, is that in 1990 Yemen refused to join the war against Iraq and Saudi Arabia consequently expelled 850,000 Yemeni workers.”    

         If you want to know what other people think of us, consider those occupying armies and 3 new aggressions (we have probably continued “covert action” in Iran so perhaps 4 more) fueled with murders of civilians by drones.  Even though Obama has cut out torture, it is hard to believe that rampant use of drones, justified in America by constantly mentioning Al-Qaida but largely slaughtering civilians as everyone else sees, will help very long.  The use of drones because CIA can, comparable to the CIA torture program which Ali Soufan and the FBI warned repeatedly against – see What the torturer knew here – is, on the face of it, a moral and foreign policy disaster.  For every “terrorist” we occasionally kill, we make myriad new enemies, very likely, generations of enemies, those who will grow up to hate us,  through the killing of innocents.  The privatized war complex does not slow down   I should note: it is better to speak of these wars as colonial or Imperial, recalling Lenin, rather than the term of art neocolonial.  Yes, the U.S. wants to dominate without hanging on directly – in the form of aid and weapons sales to national armies, what Nixon once called “Vietnamization,” so one might today speak of “Iraqization,” “Afghanization.” “Yemenization,” “Pakistanization.” But the presence of permanent American military bases as in Iraq (despite equivocation in the State of the Union, Obama plans to leave some 50,000 "non-combat" troops in Iraq just in case.  "Globalization" is the American elite's desire – but in the Bush-Cheney and Obama periods, our leaders have been suckered by Bin Laden.  The aggressions, occupations and surges pursued by Republicans and Democrats are bringing America down more swiftly than anyone could have imagined at the end of the Clinton period in 2000.  Obama's untouchable mercenary budget – 3 times the war budget during the Cold War – while he conjures the sufferings of the ordinary people who need jobs, the middle classes that are vanishing into the poor, the older people whose illness makes them bankrupt is the sign, even with the most decent President we are likely to see, of these priorities.  Even Obama who is a dangerous leader for America from Bin Laden’s standpoint in that he has set out to diminish tensions, to treat Arabs decently, to try to negotiate solutions, and who does not have a swelled head, has been forced by the mercenary war complex and the right-wing two step in American politics, to stumble blindly downward…

Obama and the Permanent War Budget

It's been a good decade for the Pentagon. The most recent numbers from Capitol Hill indicate that Pentagon spending (counting Iraq and Afghanistan) will reach over $630 billion in 2010. And that doesn't even include the billions set aside for building new military facilities and sustaining the U.S. nuclear arsenal.

But even without counting the costs of the wars in Iraq and Afghanistan, the Department of Defense budget has been moving relentlessly upward since 2001. Pentagon budget authority has jumped from $296 billion in 2001 to $513 billion in 2009, a 73% increase. And again, that's not even counting the over $1 trillion in taxpayer money that has been thrown at the wars in Iraq and Afghanistan. Even if those wars had never happened, the Pentagon would still be racking up huge increases year after year after year.

And perhaps most disturbing of all, the Pentagon budget increased for every year of the first decade of the 21st century, an unprecedented run that didn't even happen in the World War II era, much less during Korea or Vietnam. And if the government's current plans are carried out, there will be yearly increases in military spending for at least another decade.

We have a permanent war budget, and most of it isn't even being used to fight wars - it's mostly a giveaway to the Pentagon and its favorite contractors.

What Can Be Done?

For starters, the Pentagon needs to cut unnecessary weapons systems that were designed to meet Cold War threats that no longer exist. A good place to look for these kinds of cuts is in the Unified Security Budget, an analysis provided annually by a taskforce organized by Foreign Policy In Focus. Its most recent recommendations call for over $55 billion in cuts in everything from unneeded combat aircraft to anti-missile programs to nuclear weapons spending.

To their credit, President Obama and his Secretary of Defense Robert Gates have sought to eliminate eight such programs, from the F-22 combat aircraft to the Kinetic Energy Interceptor (a leftover from the old "Star Wars" program). An analysis recently produced by Taxpayers for Common Sense indicated that six of the eight proposed program cuts stuck. This is an impressive record, given the need to fight the weapons contractors and their pork-barreling allies in Congress to get the job done. But as the analysis also notes, additional spending on other programs added up to $1 billion more than the amount saved by the cuts.

This shouldn't be surprising. As a candidate for president, Obama told a rally in Iowa that it might be necessary to "bump up" the military budget beyond the record levels established by the Bush administration. And in announcing the administration's proposed weapons cuts in spring 2009, Secretary of Defense Robert Gates made it clear that he was seeking to rearrange priorities within the Pentagon, not reduce its budget. Gates sought more funding for equipment that would support counterinsurgency operations - like unmanned aerial vehicles - and less for systems designed to fight a Soviet threat that no longer exists - like the F-22 combat aircraft. And he got pretty much what he asked for.

Reducing U.S. Reach

Another area for savings would be to cut the size of the armed forces. But Obama campaigned on a promise to carry out a troop increase of 92,000, mirroring proposals made by the Bush administration. And his commitment of 30,000 additional troops to Afghanistan might set the stage for even larger increases in the total U.S. forces at some point down the road.

Finally, any real savings in U.S. military spending would need to be accompanied by a reduction in U.S. "global reach" - in the hundreds of major military facilities it controls in Africa, Asia, Europe and Latin America. But - in parallel to the war efforts in Iraq and Afghanistan- U.S. overseas-basing arrangements have been on the rise, not only in Iraq and Afghanistan themselves but in bordering nations.

So, barring major public pressure, don't expect the overall Pentagon budget to go down anytime soon. We can certainly still achieve some real reforms, from the elimination of outmoded systems like the F-22, to cracking down on war profiteering, to supporting the Obama administration's indispensable efforts to cut back the size of the U.S. nuclear arsenal. At least for now, though, making the Pentagon do with less when most communities in the country are suffering from the deepest economic downturn since the Great Depression is not in the cards. Not unless large numbers of us make it an issue.

'Peace Prize' President Submits Largest War Budget Ever

Obama Seeks Record $708 Billion in Defense Budget

WASHINGTON - President Barack Obama on Monday asked Congress to approve a record $708 billion in defense spending for fiscal year 2011, including a 3.4 percent increase in the Pentagon's base budget and $159 billion to fund U.S. military missions in Iraq, Afghanistan and Pakistan.

The White House budget request also included $33 billion in additional funding for fiscal 2010 to pay for increasing military and intelligence operations in Afghanistan and Pakistan, and drawing down U.S. forces in Iraq. That comes on top of $129.6 billion already provided for the current fiscal year, which ends September 30.

The Pentagon's base budget request of $549 billion is up $18 billion from $531 billion in fiscal 2010, and will pay for continued reforms of defense acquisitions, development of a ballistic missile defense system and care of wounded soldiers.

The budget also calls for cancellation of several major weapons programs, including Boeing Co's C-17 transport plane, saving $2.5 billion, and a second engine for the Lockheed Martin Corp F-35 fighter jet, saving $465 million in fiscal 2011 and more than $1 billion longer-term. The White House tried to kill both programs last year, but lawmakers revived them during the budget process.

The second engine is being developed by General Electric Co and Britain's Rolls-Royce as an alternate to the main engine built by Pratt & Whitney, a unit of United Technologies Corp.

The proposed budget also kills plans for development of a new Navy cruiser, scraps plans to replace the Navy's EP-3 intelligence aircraft and halts work on a missile early-warning satellite, opting instead to upgrade the Space Based Infrared System satellite already being developed by Lockheed.

The budget proposal also calls for a delay in replacing two new Navy command and control shops until after 2015, a move the White House said would save $3.8 billion across the Pentagon's five-year defense plan. The Navy had planned to buy one command ship in 2012, and a second one in 2014.

Procurement of a new amphibious vehicle being built by General Dynamics Corp for the Marine Corps would be delayed by one year, saving $50 million in fiscal 2011 and cutting risk by allowing more time for testing.

The Pentagon also said it would further reduce its use of high-risk contracts in areas that related to time, material and labor hours by 17 percent through the end of 2011.

The budget underscored the administration's commitment to a "robust defense against emerging missile threats," saying it would pay for use of increasingly capable sea- and land-based missile interceptors and a range of sensors in Europe.

The Pentagon's budget continues to fund new weapons already under development, including the F-35 fighter, a new ballistic missile submarine, a new family of ground vehicles and the P-8 surveillance aircraft built by Boeing.

It will also pay for more unmanned planes, helicopters, electronic warfare capabilities and cybersecurity measures.

Overall, the budget includes $112.8 billion for weapons procurement, up from $104.8 billion in fiscal 2010, and $76 billion for research and development, down from $80 billion.

Democratic internationalism and democratic theory


       Here is the draft of an article, Equal Rights as the Center of Democratization, which I referred to in the video of my lecture on What's wrong with the democratic peace hypothesis? at Illinois State last November here. Initially delivered at a meeting of the American Philosophical Association West, this article elaborates the democratic theory underlying two other posts, "A Tale of 'Powerful Pacifists': Empire and political science" here and "Political Science and American aggressions" here.  The former criticizes David Lake's bizarre claim that democracies take out powerful authoritarian regimes while counting all sorts of colonial and neo-imperial wars (US aggression against Mexico in 1846, the war in Vietnam) as somehow democratic efforts (nearly 15 of his 33 examples).  It reveals the debilities of a kind of quantitative political science. The latter explores Ido Oren's account of the political history of the discipline, including Woodrow Wilson's (the sixth President of the APSA) admiration for Aryan democracy in Germany.  Germany which included between 1890 and 1914 elections to the Reichstag of many Social Democrats was arguably a parliamentary democracy with some limitations; if so, a paradigm case for the democratic peace hypothesis - that democracies do not go to war with one another - fails.  A more explicit democratic conception, as in this latest article, helps provide a framework for exploring the dubious handling of evidence in a popular political science apology for American belligerence. Political science rarely makes a public stir. It is an unusual political science hypothesis which could be averred by President Clinton and the second President Bush to justify anti-democratic intervention and aggression. But this is the Emperor's new clothes rather than science.

         The article seeks a conversation among and contrasts the very interesting pragmatist argument of Jim Bohman in Democracy among Demoi, John Rawls’ Law of Peoples and my Must Global Politics Constrain Democracy? (Princeton, 1999) as ways of thinking about the limited justice which can be achieved, largely from below, internationally.  It adds strategic substance to Hilary Putnam’s striking “The Epistemology of Unjust War” here and my comments "A philosopher looks at war" here.  Based on years of anti-war activism, Hilary’s argument gives a new account of what is useful in or rather, curtails misuse of just war theory, and also articulates what is true in the notion of a  democratic peace centered in citizen movements internationally from below.  This paper also adds to the conversation I began with John Mearsheimer in "Why John Mearsheimer and I agree about Obama’s Tragic Escalation in Afghanistan" here.    As a way of looking at democratic internationalism though a conversation with sophisticated realisms (John’s) and pragmatisms (Hilary’s, James’s), all of these pieces refine Must Global Politics Constrain Democracy?   They will perhaps form a basis for a subsequent book on democratic internationalism.  A finished version of this article will appear this spring in the philosophy journal, Ethics and Global Politics.

                                               

                                                Equal Rights as the Center of Democratization                                                                              

        Well-stated modern political or democratic theory is rights-based.  Meaningful democracy rests as a precondition on the equal rights of citizens.  This ideas stems from Rousseau’s distinction between a general will – one which is impersonal and tends toward equality, that is, the equal basic rights of citizens – and a transitory will of all.  For instance, absent equal basic rights, one might imagine a possible world in which what I have called a self-undermining series of wills of all, or the results of so-called majority rule, disenfranchises the population.  In the United States, one might think, contrahistorically, of a regime in which the women, as a majority, disenfranchise the men, the black, latin and asian women disenfranchise the white women, and by a series of reductions by further “majorities,” three people still have the suffrage, two of whom disenfranchise one. Based on Rousseau, Rawls’ theory of justice thus emphasizes the priority of the equal liberty principle over an economic difference principle. [i]   The difference principle permits those inequalities which also benefit the least advantaged.  But the priority of the equal liberty principle rules out any inequality, otherwise beneficial to the least advantaged, which enables the rich to control the government. This priority makes equal basic rights the inescapable precondition for any decent majority rule or distribution of income. Note that in principle, such a regime may be international - even a democracy of demoi in James Bohman’s phrase - rather than national.

         Now Bohman emphasizes equal rights, even imagining a goal of citizenship of the world. But his conception is not explicitly part of a democratic theory.  Instead, he defends a genealogical or aetiological  conception of how a democracy of demoi could gradually generate itself, not one based on a fully elaborated or ideal picture of democracy either nationally or internationally.  In contrast, with a precondition of equal rights, modern democratic theory suggests a different way of arguing for his approach.  Bohman, one might say, novelly emphasizes the extension of equal basic rights beyond national borders.  He seeks to capture theoretically the insights of international human rights treaties.  He  wants  institutional means, international as well as national, for realizing these decent proclamations.  He envisions institutional venues, based on the European community, for deliberations and actions which extend such individual rights.  He wants such venues to allow each, including the previously excluded, to question and participate.[ii]  He imagines a robustly “active citizenry”:

      …the issue is not merely to construct a more protective democracy, but to create conditions under which an active citizenry is capable of initiating democratization, that is, using their power to extend the scope of democratic entitlements and to establish new possibilities for creative and empowered participation.[iii]

      This paper will emphasize three points which would strengthen Bohman’s account of the rights-extending and to some extent democratizing character of what he calls democracy beyond borders.  First, his analysis downplays the central role of what I call democratic internationalism from below.[iv]  Despite an admirable emphasis on the recognition of immigrants, he fails to see the central role of economic inequality and, thus, of oligarchy – the rich dominating governing institutions domestically  as well as international regimes – in depriving ordinary people of basic rights and instigating protest.  Second, he too easily adopts the results of seemingly pro-democracy social science, in particular, the inter-democratic peace hypothesis.   The Bush-Cheney administration, he recognizes,  has undermined democratic peace, Nonetheless, Bohman imagines that this hypothesis is plausible in general.  This section will suggest, however that there is little truth in this now fashionable academic and government argument about the American oligarchy with parliamentary forms. [v]  Third, throughout the essay, I will compare Bohman’s argument both with John Rawls’ Law of Peoples and my account of democratic internationalism in order to underline Bohman’s innovations but also to strengthen his account, to make it more practical.

        What Bohman says about democratization is often not obviously or very democratic; it is, in his idiom, “decentered.”  Following John Dewey, he substitutes some participatory, deliberative publics, not very well specified, for robust democratic movements   A focus on the extension of rights as the precondition of democracy highlights what is morally admirable in his argument.  It justifies his quasi-democratization and is central to whatever level of deliberation and democracy can exist in international institutions and in modern transnational regimes.[vi] Aetiologically, one might regard the process of creation of such democratization and equal rights as mutually interacting.  But what gives the process of democratization its moral force is the inclusion, as Bohman emphasizes, of the previously shunned and oppressed, the extension of basic rights. 

          Bohman draws his aetiological model for a democracy of demoi from the European Union which has required the extension of individual rights  in new or prospective  members, for instance,  in  Eastern Europe or Turkey, and has furthered  the internationalism of its citizens.[vii]   In addition, the incorporation of Muslim Turkey might  dialectically extend democracy within Europe itself. European oppression of illegal Muslim immigrants from Morocco, many of whom drown in attempting to cross the Mediterranean to Spain, or the disregard for Algerians in France, protested by recent rebellions in the Paris suburbs, or the preference for mainly white immigrants from Eastern Europe as opposed to blacks from Africa are basic challenges for making Europe decent.   

          Critical of the weakness of the European Parliament, Bohman imagines an unfolding of democracy that allows a “reflexive” challenge to its own inadequate bases: a discussion of the further extension of rights to new groups and citizens.  He admires an Open Method of Coordination in which different countries have diverse but shared forms of deliberation on national policies which can be argued about, coordinated or chosen from at the international level.  Compared to Rawls’ Law of Peoples, these are important  advances,[viii]  but whether they amount to genuine democratization – the capacity of each citizen to play an equal role, given a comparable level of experience, ability and dedication, in setting the national and international public agenda one might doubt.  Bohman’s enthusiasm for these processes leads him to say too easily that they are (potentially) democratic.  His argument thus suffers from the actual lack of democracy in the European Union – one does not routinely think of “Eureaucrats” in Brussels and  democracy together.  There is a great distance between the current actuality and Bohman’s hopes in weakly specified democratic innovations.[ix]   The democracy of demoi argument is characterized by an opacity of the democracy Bohman recommends. 

           In contrast, Bohman could emphasize the expansion of rights and the creation of institutionalized[x] democratic contexts of protest, ones in which some individuals are allowed to participate and challenge prevailing, exclusionary practices.  Both of these ideas are democracy-tending; neither amounts to full or radical democratization. In these respects, Bohman recommends advances in what I might call the international underpinnings for democracy.  But if he spelled out the political and moral limitations on transnational democracy rather than using the term broadly or loosely in  contrast to other views, his argument would be more appealing.

       In addition, though he rightly criticizes “juridification,” Bohman’s argument about a democracy of demoi is overly institutional and legalistic.   In contrast, consider what I call democratic internationalism from below: movements in different countries against the oppressive policies of one or all of their own states.  For instance, preceding the Anglo-American aggression in Iraq, the greatest international anti-War movement in world history before a War took place. If one examines the initial Bush Pentagon proposal for “shock and awe” – to make of Baghdad a “Nagasaki” – this movement saved many innocent Iraqi lives. The aggression still murdered an unknown number of people – the Bush regime shunned collecting statistics about its crimes -  but nothing like the original plan.  This was one  concrete moral effect of a great international countermovement from below.[xi]    A second positive impact was to make American and other citizens aware that they had real power internally and internationally.  In the United States, for example, this empowerment eventually had an effect in electing Obama and shifting the direction of the polity toward a common good in many ways.[xii]  

         Such internationalist movements are genuinely democratic in two respects: 1) to stand up for moral decency, they rely on ordinary citizens gathering from below against the policies of their own state(s) as well as a centralized, profit-hungry mainstream or  establishment media, [xiii]  2) they provide the main way to achieve the advances suggested by decent theories of international affairs, such as Rawls’s or Bohman’s.  They leave any practical mechanisms unspecified, except that for Bohman, immigrants or their representatives can raise their voices in specific forums in Europe.  But such movements help advance  immigrant demands, or challenge the Iraq aggression as 2 million demonstrators did in Madrid against Aznar on February 16, 2003.[xiv]      

       Yet in most cases, a proponent of Bohman’s view might suggest, such movements are ephemeral in the sense that they do not change institutions as opposed to challenging policies.  In contrast, he might say, we need an institutionalized democratization among demoi.    Though Bohman mentions the Chartist movement of English workers, demanding the 10 hour working day and universal suffrage, and notes protests against the World Trade Organization, he downplays them.  In arguing for Bohman’s position, however, there is no necessity to do this.  One could simply add to the virtue of democratic internationalism from below, the need for a democracy of demoi to produce more institutionalized or consolidated rights-advances and deliberative results:[xv]

      We ought not to overlook the deep differences between international and national public spheres and civil society, most of which concern the ways in which publics interact with institutions.  Given that formal international political organizations such as the WTO do not interact directly with political publics, oppositional counterpublics form around them to exercise influence indirectly by mobilizing popular opinion.  To the extent that transnational associations help to form such counterpublics, they contribute to the capacity of international society to democratize its relations of power and authority.  However, counterpublics do not rule; and even if they did, we should not take this as a sign of an emerging global public that speaks for the collective will of humanity (or even one that speaks for multilingual Europe). [xvi]

       Even Bohman’s remark about oppositional counterpublics is elliptical and may not include demonstrations, strikes or civil disobedience.  His comment about such movements being unrepresentative of “an emerging global public” invites the rejoinder: are you really claiming that commercial experts from a few nations, disproportionally the United States, do?  Did not the 50,000 nonviolent resisters against the World Trade Organization in Seattle in 1999 represent the poor and the excluded[xvii]?  Plainly, international protest movements represent – and seek to represent -  the excluded more than inimical and unaccountable capitalist institutions.[xviii]  And what is one to make of an argument where fairly obscure institutional procedures such as Open Methods of Coordination supposedly represent democratic publics to the extent they can be – such publics are mainly outside institutions  - but international mass protest movements, raising demands about forgiveness of debt or fair trade or to block Bush’s aggression in Iraq – do not?

      While Bohman is right that “counterpublics do not rule,” he mistakenly diminishes their public role    Once again, resistance movements helped to create the conditions for and often to support  Obama’s election.  Obama’s Presidency has  banned torture, restored, to some extent, constitutional rights, and proposed or enacted a variety of decent social polices about education, health care, and the environment.[xix]  Further, the demands democratic protestors who gathered outside the G-20 meeting in London on April 3, 2009 with such signs as “Nature doesn’t do  bail-outs” fuse the disastrous threat of global warming[xx] with the need for a productive, rather than a corrupt, finance-driven, casino economy in the U.S and internationally.  That impulse from below newly articulates what is vital in Obama’s program and seeks to transform it.[xxi]   (Nonetheless, by further escalating the U.S. occupation of Afghanistan, Obama has undermined many of these accomplishments).

         Bohman’s error here mirrors Rawls’.  Rawls’s wants a movement toward a law of peoples which bars aggression; yet he provides no causal, social mechanism to achieve it.  In fact, the Law of Peoples ends on a bleak Kantian note:

      If a reasonably just Society of Peoples whose members subordinate their power to reasonable aims is not possible, and human beings are largely amoral, if not incurably cynical and self-centered, one might ask, with Kant, whether it is worthwhile for human beings to live on the earth. [xxii] 

 If we cannot prevent aggression and deter American-style wars as a way of “resolving” disputes, it is doubtful that humanity has a long (say two centuries) future on this planet.  Global warming and the desolation of war go hand in hand.  This is all the more reason to underline the importance, however difficult, of democratic solidarity from below.       

      Bohman rightly thinks of ways within or broadening institutions to democratize them. Amending Bohman, one might say, the interplay or dialectic of these two forces, democratic internationalism from below on particular outrages, an increasingly institutionalized democracy of demoi, is likely to forge whatever advances in decency are possible.[xxiii]

           Bohman also rightly focuses on extreme destitution and some of the depradations of capitalism.  But he is less insightful on this point that Rawls, who often emphasizes the dangers of extreme inequalities of wealth in corrupting government and making a formally democratic regime serve the rich.[xxiv]   Speaking mistakenly of “natural slaves,” Aristotle had no concept of exploitation.  But he did have a concept of oligarchy, where the rich corrupt government and opinion, and use the regime in their narrow interests.  Yet atheoretically, Bohman does not note the devastating impact of economic inequality on equal or democratic liberty.  In addition, Bohman refers briefly to exploitation only to dismiss it on behalf of his notion of the domination of those formally excluded in democracy, particularly the immigrant populations that (capitalist) regimes have historically preyed on:

       One might even claim that the presence of economic actors such as corporations make the term `exploitation’ descriptively more accurate.  However, exploitation does not identify the distinctly normative character of these forms of authority.  As large-scale organizations, often with vast resources, corporations operate more as nascent political authorities in that they are quite successful in imposing statuses and duties in terms of cooperation, even upon states.  While not employing simple coercion, such organizations acts as dominators by devaluing citizenship and by being able to change important statuses and powers necessary for democracy.[xxv]

       In using the word domination, Bohman refers to a new stage of oligarchy with some generality or indefiniteness and without the name. In contrast, honoring Aristotle, Rousseau and Marx, I call modern capitalist democracies oligarchies with parliamentary forms.[xxvi]  As the Bush period has shown, under novel threats, such forms are frail.  Would be autocrats may supplant parliaments and the rule of law with an anti-Constitutional, anti-individual rights regime: an imperial tyranny or police state, characterized by the abolition of habeas corpus (the right of each person to a day in court), illegal spying on citizens, and torture.  In the United States, these crimes were linked to a redistribution of wealth from the bottom 80% of the population to the top 1/10th of one per cent. But even the previous oligarchies with parliamentary forms served the rich, as in the Clinton period, and achieved previously unknown levels of inequality.[xxvii]

          In addition, though Rawls prioritizes the equal liberty principle over the difference principle, he does not discuss,  social theoretically or empirically, whether the realization of equal liberty is possible short of a market system based on equal incomes.[xxviii]    In any case, existing inequalities enable the financially privileged to dominate the government[xxix]  and corrupt equal liberty.  In normal times, banks and financial megacorporations like AIG[xxx] dominate politicians and the media; short of revolt, homeless people, immigrants and ordinary citizens, including the middle class, have little power to make the government side with them.  In the current global economic disaster, with increasing protest from below, some new regulation of the financial sector, including nationalization or a breaking up of these mega-corporations, may be possible. [xxxi]   But full employment – 17,5% of Americans are currently unemployed – or limiting foreclosures are even further away and will require large movements. [xxxii]

          Further, such popular influence from below is no equivalent to democratic control of the public agenda or an equal influence of ordinary citizens and such powerful institutions.  In Rawls’ or Dahl’s terms, this notion of shaping the agenda parallels Bohman’s idea of minimal democratization – that each person, especially illegal immigrants and the previously excluded, be empowered to raise questions for deliberation.   Given the realities of capitalism, Rawls’s prioritization of the principle of equal liberty effectively rules out existing (and likely many imaginary, less glaring) forms of capitalist inequality, on liberal or republican grounds.[xxxiii]   Bohman does not take up the primacy of equal liberties in democratic theory and thus the problem of oligarchy  perhaps because, absent these, an ideal discussion of democratization among demoi seems more hopeful.  But one must recognize the obstacles to achieve what democratic progress, especially from below, is possible.

         Still, minimal democracy, as Bohman suggests, maintains important rights and may limit dramatic evils.  Here he relies on two social science theses, 1) Amartya Sen’s argument that even having an oppositional newspaper prevents famine and 2) the interdemocratic peace hypothesis - the notion that democratic regimes don’t go to war with another.  As Bohman rightly notes, the second thesis is much weaker – dramatically undermined by recent American rogue “unilateralism” and torture as he underlines – than the former.  Bohman contends that an international diversification of democratization – one might even think here of the role of the not very democratic United Nations Security Council in denying a quasi-legal fig-leaf[xxxiv] for the Anglo-American aggression in Iraq  – might mitigate this dangerous trend. 

            But as this section will demonstrate, the inter-democratic peace hypothesis, on which he hopes to rely, is weak.  Kant’s initial thought – that in an ideal republic compared to a feudal monarchy and its frivolous “pleasure parties of war,” citizens might limit aggressions by the executive -  is promising.  But in our kind of oligarchy with parliamentary forms the distance between ordinary people and government  is greater than in such a republic.   In addition, the bent of the military-industrial-media-think tank “expert”-political complex toward war is fierce.[xxxv]  It can only be limited by mass protest from below.

       Even Amartya Sen’s thesis about democracy and famines has an important qualification, however, which Bohman overlooks and is also relevant for the sharper deficiencies of the inter-democratic peace hypothesis. In situations of colonialism or extreme racism, despite a parliamentary regime, famine is likely to occur. 

         For instance, Sen emphasizes this feature of the Irish famine of 1848.  There was enough food to go around, as Bohman notes.  Yet Charles Edward Trevelyan, head of the English Treasury,

          who saw not much wrong with British economic policy in Ireland (of which he was in charge) pointed to Irish habits as part of the explanation of the famines.  Chief among the habitual failures was the tendency of the Irish poor to eat only potatoes, which made them dependent on one crop.  Indeed, Trevelyan’s view of the causation of the Irish famines permitted him to link them with his analysis of Irish cooking: ‘There is scarcely a woman of the peasant class in the West of Ireland whose culinary art exceeds the boiling of a potato.’

     As Sen amusingly replies,

         The remark is of interest not just because it is rather rare for an Englishman to find a suitable occasion for making international criticism of culinary art.  Rather, the pointing of an accusing finger at the meagerness of the diet of the Irish poor well illustrates the tendency to blame the victim.  The victims, in this view, had helped themselves to a disaster, despite the best efforts of the administration in London to prevent it.[xxxvi]  

      To take a contemporary example, racism conditioned the Bush’s administration’s non-response to hurricane Katrina,[xxxvii] coupled with the later driving out of New Orleans of many black families.   Racism can thus paralyze even a formally parliamentary regime and turn its leaders into murderers.[xxxviii]  Despite Bohman’s omission of racism, his overall insistence on the inclusion of the previously excluded would also make it easy for a proponent of his argument to emphasize this point. In any case, Sen’s contrast of the great Calcutta famine of 1943 under British rule and Indian democracy’s prevention of famine since is the single most  powerful argument for even a minimal democratic regime.

         The inter-democratic peace hypothesis, however, is much weaker.  Bohman himself worries about the conditions under which the thesis can hold.  For a limited period of the Twentieth Century, he affirms this idea as accounting for an absence of wars between democracies.  Given a new era of terrorist threats, national security states, torture and the dictatorial powers of the American executive arrogated by the Bush regime, however,  he now sees this hypothesis as endangered:

        A new dialectic between the capacities of citizens  and the instrumental powers of states has not yet reached any equilibrium, so that there has now emerged a strong negative influence on democratic practices and human rights generally because of the use of state force for the sake of security.  Further, liberal democracies have not only restricted some civil rights, but have violated human rights with the use of extralegal detention centers and torture in order to achieve security.  As such, they might be said to have become less democratic, at least in the active sense  of creating enabling conditions for the exercise of normative powers.[xxxix]

 

         Practicing torture on the indefinitely detained and  illegally spying on most Americans, for example, are far worse than Bohman’s overly cautious “[not] creating enabling conditions for the exercise of normative powers.”  Far from achieving “security,” American torture at Abu Ghraib, as an interrogator, whose pen name is Matt Cooper, has argued, encouraged the enlistment of many young Arabs with Al-Qaeda in Iraq, and is responsible, through suicide bombings, for the deaths of many American soldiers as well as Iraqi civilians.  In addition, by failing to prosecute high officials of the Bush administration for ordering these crimes, Obama and the Democrats have, in the phrase of Yale constitutional lawyer Jack Balkin, created a bipartisan legal regime around abolishing habeas corpus (the right of each prisoner to a day in court and not to be tortured, the foundation of English and American law going back to the Magna Carta) and sabotaging the international legal regime, once fought for by the United States, which centers on barring torture.  To spell out the implications of Balkin’s thesis, this is a new “legal” regime to abolish what Jeremy Waldron rightly names the steoretoype of law, to make government illegality “legal.” [xl] 

       As Bohman suggest, his new regime is an attack on law, on equal basic rights and on democracy.  For instance, the routine governmental practice of indefinite detention and torture accompanies illegal spying on citizens and harassment of protest.  On February 16, 2003, one and a half million people tried to demonstrate in New York at the United Nations against the war in Iraq.  500,000 were cordoned off in separated caged areas at the UN plaza.  The other million, lined up, shoulder to shoulder, for 30 blocks, were diverted from the rally by police.[xli]   Thus, what brutally affects often innocent Arabs picked up off the street also affects citizens.  Freedom is like a linked chain; what deprives the other and “the least of these” of freedoms also oppresses citizens.[xlii]   

       Only because the Bush administration was so massively incompetent at war and managing the economy has America narrowly escaped becoming a police state.  In the context of torture, Bohman rightly suggests that an international context of democratization – at least human rights agreements, the International Criminal Court and, one might add, democratic pressure from below – have a chance of bringing to trial some of those responsible. 

         Three problems, however, undercut even Bohman’s cautiously stated version of the inter-democratic peace hypothesis.  First, the Bush administration did not just institute torture, secret sites and extraordinary rendition and involve tyrannies like Syria or Uzbekistan or Morocco; it also sweepingly corrupted the European democracies.  In upholding the Binyam Mohammed suit, the British High Court - the “Law Lords” - reported that British intelligence knew that Mohammed, a British resident,  had been severely tortured in Morocco.  The CIA supervised; nonetheless, at a minimum, the Blair government knew of the torture and did nothing. Upholding the rule of law, the Brown government has already launched an investigation of the accomplice role of English officers and officials in this torture.[xliii]   Similarly, in Italy, a Muslim cleric was kidnapped on the streets of Milan by the CIA.  An Italian courts has now convicted, in absentia,[xliv]  26 members of this (in this respect) criminal organization.[xlv] 

         But an issue plainly exists about what the Italian government and intelligence services knew about this and other crimes. As the world’s leading military and rogue power, the Bush regime corrupted many other governments, including many democracies.  Although Bohman does not spell this out, this is no sign of inter-democratic peace, but rather of inter-democratic aggression.  Whether the rule of law and the bar on torture – the first and chief pillar of international law – will be restored is a question.  Here, the action of citizen movements against torture, the international Red Cross, and decent lawyers – those who understand what law has been since the Magna Carta – will need to play a great role.[xlvi]

      Secondly, Bohman contrasts the current authoritarian threat to democracy with a previous period in which the inter-democratic peace hypothesis supposedly held.  But the same caveat applies with regard to this thesis as Sen emphasizes for famines.  During and following the Cold War, the United States government has overthrown at least 10 elected,  governments, largely in less developed countries whose citizens are nonwhite.  Among others, the US government has overthrown democracy in  Guatemala in 1953, Iran in 1954,  Guyana in 1964, Indonesia in 1965, Brazil in 1965, Chile in 1973; in the post Cold War period, the US has overturned the elected regimes of Aristide in Haiti twice,; in 2002, it supported an unsuccessful coup against Venezuelan President Hugo Chavez. It  has had its eyes on bombing Iran –  Ahmenadinijad was at one time elected prime minister - throughout the Bush-Cheney period.   Obama’s recent treatment of Iran as a party with serious national interests, deserving of at least mutually respectful negotiation is a significant break with previous policy.[xlvii]  Perhaps it helped inspire the democratic revolt against Ahmenidinijad’s stealing of the 2009 election.

         Instigated by the Central Intelligence Agency as part of covert, illegal American policy, these actions were plainly inimical to nonwhite democracies.  But in elaborating the inter-democratic peace hypothesis, social “scientists” distinguish between wars where both sides lose at least 1,000 soldiers and interventions.  In a bizarre philosophy of science rationale, they have sought to operationalize wars as opposed to interventions. Operationalism seeks to escape controversy about difficult concepts and produce independent, ostensibly atheoretical ways of measuring them.  But here quantitative social “science” has lost the moral thread,  By slight of hand, democracies are alleged to be peaceful toward one another, through citizen influence from below – I use the term peaceful in the forceful moral sense that Bohman gives it – but in fact, the American democracy has organized a pattern of subversion, violence, overthrow of regimes, and murder or ostracism of leaders,[xlviii]  involving at least ten democraciees. 

        In addition, the US government has shored up brutal standing armies and often overseen torture in military dictatorships in a much larger number.[xlix]  That government

has worked against peace, human rights, and democracy. The shard of truth in the inter-democratic peace hypothesis is that citizens – and international movements – can make a difference in stopping or limiting wars of aggression as in Vietnam and Iraq.  Further, citizens who must fight and die make it more difficult – even when reactionaries in Congress disparage “freedom fries” – to go to war with France.  But the problem occurs when the regime carries out such policies covertly, covered up by the bipartisan consensus on foreign policy in Congress.[l]

      Third, Rawls rightly chooses non-aggression as the central characteristic of his Law of Peoples.[li]  He did not think to include non-torture here.[lii]  But international law bars  aggression and torture as its cardinal points, ones long fought for by the United States and enshrined in American law.   For instance, Article 2, section 2 of the Convention against Torture says that “No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability, or any other public emergency may be invoked as a justification for torture.”  In addition,  Article 6, section 2 of the Constitution, the Supremacy Clause, makes treaties signed by the United States the highest law of the land.[liii] 

       In conversation, Rawls shared with me his initial  hopes for the democratic peace hypothesis.  In response, I underlined the pattern of violent American interventions against democracies.  He then added a long paragraph  to Law of Peoples on the dangers of secret interventions,

        Hence, given the great shortcomings of actual, allegedly constitutional democratic regimes, it is no surprise that they should often intervene in weaker countries, including those exhibiting some aspects [sic – the US, too,  has only some aspects] of a democracy, or even that they should engage in war for expansionist reasons.  As for the first situation, the United States overturned the democracies of Allende in Chile, Arbenz in Guatemala, Mossadegh in Iran, and some would add, the Sandinistas in Nicaragua.  Whatever the merits of these regimes, covert operations against them were carried out by a government prompted by monopolistic and oligarchic interests without the knowledge or criticism of the public.  This subterfuge was made easier by the handy appeal to national security in the context of superpower rivalry, which allowed such weak democracies to be cast, however implausibly, as a danger.[liv]

     But he then  imposed five ideal conditions, two of which bar oligarchy, on the kinds of democratic regimes which one might hope would be able to resist pressures for aggression against nonwhite peoples:

          b) a decent distribution of income and wealth meeting the third condition of liberalism: all citizens must be assured the all-purpose means necessary for them to take intelligent and effective advantage of their basic freedoms.  (In the absence of this condition, those with wealth and income tend to dominate those with less and increasingly to control political power in their own favor)

     …e) Public financing of elections and ways of assuring the availability of public information on matters of policy (A statement of the need for these arrangements merely hints at what is needed both to ensure that representative and other officials are sufficiently independent of particular social and economic interests and to provide the knowledge and information upon which policies can be formed and intelligently assessed by citizens.[lv]

       Taking account of anti-democratic interventions and oligarchy, Rawls’s argument is, in these respects, more apt than Bohman’s.  In addition, in contrast to Rawls’ ideal democracy, the oligarchic Bush-Cheney administration used the idea of democratic peace to strike at “enemies,” including nonwhite democracies.  For instance, Bush’s campaign against the “axis of evil” did not bomb Iran only because the imperial power got mired down in its aggression in Iraq.[lvi]   The rationale of the National Security Strategy of the United States 2003 is to make other countries democracies at gun-point and thus expand the supposed democratic peace.  Of this rationale,  Bohman says elliptically “It is sometimes thought that this argument could justify military intervention by democratic states into nondemocratic one for the sake of establishing more democracies as a means for peace and security.”[lvii] 

         No such intervention can be justified. In addition it makes American citizens less secure.  Through the “[anti]Patriot Act,” illegal spying on Americans and torturing them, it has dramatically abridged equal liberties at home.  In what I call the anti-democratic feedback of international politics, Bush’s  policy pursued an unjust imperial goal (establishing military bases in Iraq and controlling the oil) linked to the subversion of American democracy.  My argument draws on Thucydides, Aristotle, Machiavelli, Montequieu, Rousseau and Marx[lviii]; it brings political theory into the heart of the study of the modern American regime and a previously anti-democratic international relations theory.

          Because he ignores American oligarchy, Bohman also does not recognize that  the inter-democratic peace hypothesis in its current form has very limited merit.  At most, it only seems to rule out full-scale wars among “advanced,” mainly white democracies (Japan now qualifies as well).[lix] Bohman  is once again elliptical about an extreme ideological consequence of the inter-democratic peace view, which one might infer, from his use of the passive voice, he disapproves of (and would be right to do so):   

      One such generalization that is used to lend support to the benefits of a democratic order is the so-called `democratic peace hypothesis,’ which has often been used by moral cosmopolitans and liberal nationalists to justify the policy of fostering democracy within states as the best means of creating a peaceful international order of politically organized peoples.  It is sometimes thought that this argument could justify military intervention by democratic states into nondemocratic ones for the sake of establishing more democracies as a means for peace and security.[lx]

        But the American aggression in Iraq and its many horrifying consequences have given the lie to the invocation of an ostensible inter-democratic peace hypothesis by imperialist neoconservatives: to establish “democracy” at gun-point. The accompaniment of torture and the pillaging of Iraq for private profit, divided between Halliburton, Blackwater (now Xe), and just plain American and Iraqi corruption,[lxi]  should give pause even to the onetime proponents of such intervention.[lxii] 

            As Rawls emphasizes and Bohman notes, the democratic peace hypothesis is something ideal, imagining greater citizen influence on the normal operations of such oligarchies, than something actual.  The aggressive, imperialist neoconservative deployment of this thesis has discredited it.  Bohman rightly seeks a democracy of demoi to limit such aggressions. But he has not plumbed the depth of the problem or confronted the difficulties for even an  ideal democratic peace hypothesis. That is perhaps why Bohman does not emphasize the role of democratic internationalism from below.

           Still I agree with Kant that republics enfranchise citizens to protest against the “pleasure party of war.’  We must seek to limit or overturn capitalist inequalities, to mitigate or eliminate oligarchy.  As the protest against the Vietnam War and the Iraq war show, ordinary people can come to see through racism and  oppose elite wars of aggression.  Protest from below accomplishes a great deal, and more sophisticated protest, allied with those in national and international institutions who either would like to do something decent or realize not only the hopelessness but the evil of neoconservative imperialism, would accomplish even more.  But such protest, not a social “science” inter-democratic peace hypothesis combined with an increasingly institutionalized democracy of demoi, is the best hope for realizing the decent.  The ideal will be much harder to achieve.
